Terms of Use

These Terms of Use are an agreement between you and Doniyor Umarov (“we”, “us”), the publisher of BabyCare. By downloading or using BabyCare you accept them. If you do not accept them, please delete the app.

1. License

We grant you a personal, non-transferable license to use BabyCare on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, redistribute, reverse-engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.

2. BabyCare is not medical advice

BabyCare is a record-keeping and reference tool for parents and carers. Its sleep targets, wake windows, growth percentiles, vaccination schedules, milestone lists and allergen guidance are general information drawn from published references. They are not a diagnosis, a treatment plan, or advice about your child.

Always consult a qualified health professional about your child's health, and never delay seeking care because of something the app showed you. If you think your child needs urgent help, contact your local emergency service. Reminders are a convenience, not a safety system — never rely on the app alone for medication timing or any other health-critical event.

3. BabyCare Plus

The app is free to use for recording sleep, feeds, diaper changes, pumping, temperature, symptoms and medication, and for the reminders attached to them. BabyCare Plus is an optional upgrade that unlocks the interpretive features: sleep predictions, trends, WHO percentile charts, the complete history, export, additional children, additional memories and custom sleep targets.

Plus is sold as a monthly or yearly auto-renewing subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy, in your local currency.

4. Billing, renewal and cancellation

Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically for the same period, at the same price, unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within 24 hours of the end of the current period.

You manage and cancel subscriptions in the Settings app under your Apple Account — not in BabyCare. Deleting BabyCare does not cancel a subscription.

Where a free trial is offered, it applies to the first period only and to first-time subscribers. Any unused part of a free trial is forfeited when you buy a subscription. A lifetime purchase is a single payment with no renewal.

We do not process or receive your payment details. Purchases, refunds and billing are handled entirely by Apple; refund requests go to Apple.

5. What happens if Plus ends

Your records are never deleted because a subscription ended. Everything you have entered stays on your device, and in your iCloud account if you enabled sync.

While Plus is not active, the free limits apply to your whole collection rather than only to new entries: the earliest child profile and the earliest twelve memories stay available, anything beyond that is locked, history is shown for the last seven days, and saved custom sleep targets stop overriding the built-in guidance. Locked content is hidden from view, not erased, and becomes available again immediately if you subscribe again. You can export your data at any time while Plus is active.

6. Your data

BabyCare stores your records on your device, and in your own iCloud account if you turn on sync. We do not operate servers for your data and we cannot see it. You are responsible for keeping your device secure and for your own backups. How we handle data is described in the Privacy Policy, which forms part of these terms.

7. Acceptable use

Use BabyCare only for its intended purpose and only in ways that are lawful where you are. Do not use it to store material you have no right to store, and do not attempt to disrupt or circumvent the app's functioning, including its purchase checks.

8. Availability and changes

We may update, change or discontinue features, including as required to keep the app working on new versions of iOS. If we discontinue the app, previously purchased lifetime access may become unavailable when the app no longer functions on supported devices.

9. No warranty

BabyCare is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that reminders will always be delivered.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, arising from your use of BabyCare. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or your statutory rights as a consumer.

11. Apple

These terms are between you and us, not Apple. Apple is not responsible for BabyCare or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

12. Termination

These terms apply until terminated. They end if you stop using and delete the app. We may end them if you materially breach them. Sections 2, 9, 10 and 11 survive termination.

13. Governing law

These terms are governed by the law of Austria, without regard to its conflict-of-laws rules, and subject to any mandatory consumer protections of the country where you live.

14. Changes to these terms

We may update these terms as the app changes. The version in the app is always the current one, and the date at the top shows when it last changed. Continuing to use the app after a change means you accept it.

15. Language

These terms may be provided in several languages for convenience. If there is any conflict between versions, the English version governs.
